Once the funding of your claim has been put in place, for example, a No Win No Fee Agreement has been signed, the personal injury claim process typically involves gathering evidence and submitting a claim to the relevant party or their insurance company.
To prove your case medical evidence and supportive documents for financial losses will need to be obtained. Preparation of witness evidence is also important to set out how the accident has affected your life and family.
Interim payments can be requested throughout the claim where liability (fault) has been admitted and rehabilitation to support you with your recovery.
Once the evidence is complete, this is disclosed to the other party for negotiation of a settlement amount; however, in the event an agreement cannot be reached between the parties, the Court will be involved in determining the amount of compensation awarded.
The Court may also be asked to determine liability where this has not been admitted by the opposing party.
